The Loss Discovery

Diagnostic Sequence

Systematic wall cavity assessment (with homeowner consent for exploratory demolition):

North basement wall (affected wall identified by homeowner)
Full length of wall (approximately 32 linear feet) opened at 24-inch intervals for cavity inspection. Findings: continuous saturation of wall cavity throughout the 32-foot length. Exterior investigation coordination with waterproofing contractor: excavated 4-foot deep test pit at the north side of the foundation exterior. Bear River Mutual reviewed the appeal over 24 days. Final coverage determination: partial coverage for ensuing damage (mold remediation and restoration scope) of approximately $22,000, but denied coverage for the exterior waterproofing repair (that was the responsibility of the builder under construction warranty).

Builder warranty coordination: The property was within the builder’s 10-year structural defect warranty period. Builder GL carrier accepted responsibility for the exterior waterproofing repair, exterior excavation, and site restoration ($21,500). Some of the builder-warranty payment was subsequently subrogated back through the homeowner’s carrier for restoration items originally billed under builder warranty.

Total loss cost: $53,470. Insurance and warranty recovery: $22,000 (Bear River Mutual) + $21,500 (builder warranty) = $43,500. Homeowner responsibility: $9,970 out-of-pocket including deductible and coverage gaps.

Outcome

Full restoration completed 49 days after initial loss response. Foundation waterproofing repaired to specification. Basement finished walls reconstructed with new drywall, insulation, and finish. Air sample clearance confirmed. Homeowners resumed normal basement use on May 27, 2024.

Key Learnings

  • Foundation waterproofing installation defects are difficult to identify pre-occupancy and often produce delayed-discovery losses 12 to 36 months post-construction. Homeowners should preserve builder warranty documentation and initiate warranty claims when defects are discovered, regardless of insurance status. Warranty and insurance coordination can produce substantially better recovery than either alone.
  • Delayed-discovery losses from construction defects often escalate to combined S500/S520 scope by the time of discovery. Extended-duration exposure produces biological growth requiring full mold remediation in addition to water restoration.
